Napolitano, Feds violating U.S. law

The Department of Homeland Security continues to violate its own federal laws with impunity. In front of the Senate Judiciary Committee on October 19, 2011  Janet Napolitano the Homeland Security Secretary explained that under the administration’s policy of exercising “prosecutorial discretion” in the enforcement of the immigration laws, Homeland Security is currently authorizing some illegal aliens to work in the United States.
The Department of Homeland Security’s own web site states the following on immigration:
 “The Department is responsible for providing immigration-related services and benefits such as naturalization and work authorization as well as investigative and enforcement responsibilities for enforcement of federal immigration laws, customs laws and air security laws.”
Why should the people be held to a set of laws when the people who enact and enforce the laws break them constantly without consequence?  This is a major issue that expands to all powers of government. Prosecutorial discretion at such levels is a dangerous tool which allows unelected officials to put their own monetary or political agendas before the welfare of the nation.  Current immigration laws state the following:

§ 1324a. Unlawful employment of aliens
(a) Making employment of unauthorized aliens unlawful
(1) In general
It is unlawful for a person or other entity—
(A) to hire, or to recruit or refer for a fee, for employment in the United States an alien knowing the alien is an unauthorized alien (as defined in subsection (h)(3) of this section) with respect to such employment, or
(B)-(i) to hire for employment in the United States an individual without complying with the requirements of subsection (b) of this section or  (ii) if the person or entity is an agricultural association, agricultural employer, or farm labor contractor (as defined in section 1802 of title29), to hire, or to recruit or refer for a fee, for employment in the United States an individual without complying with the requirements of subsection (b) of this section.
According to current US immigration laws it is unlawful to employ people who are here illegally in this country – except when it’s not as decided by Janet Napolitano and the present administration. The continued violations of the constitution are criminal actions that continue to send America down the path of destruction.  It is a path the Obama administration seemed determined to take.
